People’s Power Ministry for Ecosocialism and Waters Resolution: STANDARDS FOR THE CONTROL, IMPORTATION AND HANDLING OF HYDROFLUOROCARBONS.

  1. PURPOSE

Given that the gradual elimination of hydrochlorofluorocarbons in compliance with the commitments under the Montreal Protocol on Substances that Deplete the Ozone Layer means increased use of hydrofluorocarbons, greater control over these substances will be necessary. Therefore, the purpose of this resolution is to set standards for monitoring and regulating imports and for the proper handling of hydrofluorocarbons.

All parties in charge of handling—inter alia those who import, recover, recycle, transport, store, distribute and sell—this type of substances must be duly registered with the appropriate authorities and have been issued the respective authorization. Import permits will be valid for one calendar year and are to be applied for at the general office in charge of environmental quality where the company interested in importing these products must be registered.

Hydrofluorocarbons and their mixtures can be marketed in rechargeable or disposable pressurized containers. Disposable containers shall be handled as hazardous waste.

The packaging, labeling and handling standards applicable to ozone-depleting substances shall be applied.

Hydrofluorocarbon substances, either pure or those contained in mixtures can only be imported from countries that produce them.

This resolution will become effective on the date it is published in the Official Gazette.
